In re Congregation Shaare Zdek v. Leventhal
Supreme Court of the State of New York, Appellate Division, First Department, June 12, 2018
Petitioner is a religious corporation who sought to redevelop its synagogue building into a mixed-use synagogue and residential condominium pursuant to Religious Corporations Law §12 and Not-for-Profit Corporation Law §§ 510 and 511. The appellant opposed the petitioner’s project. The court found the appellant lacked standing to be heard in opposition because he is not a “member, officer, or creditor” of petitioner (Not-for-Profit Corporation Law §§ 511).
